1. Acceptance of these terms

By accessing whalore.com or placing an order with Whalore Biosciences (“Whalore,” “we,” “us”), you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the site or order from us.

2. Research and educational use only

All organisms, biomolecules, preserved specimens, kits, and other materials supplied by Whalore are intended for research and educational use only. They are not drugs, medical devices, foods, cosmetics, or household products, and must not be used for diagnostic, therapeutic, clinical, or any human or veterinary medical purpose. You are responsible for using all materials safely, lawfully, and in accordance with the policies and approvals of your institution.

3. Live organisms, care, and stewardship

Live organisms are delicate and require appropriate care. Before ordering, you are responsible for reviewing and being able to meet the care requirements for each species. Care parameters provided on the site are guidance based on our experience, not guarantees of outcome.

You agree to handle and house organisms responsibly and humanely and to comply with all applicable laws and institutional policies. You must not release any organism — living or dead — into the wild, local waterways, or municipal drains. When an organism is no longer needed, contact us about returning it, or end the culture humanely and dispose of it appropriately.

4. Orders, pricing, and payment

Prices are listed in U.S. dollars, and shipping is included on live organisms within our standard service area. Prices, availability, and product details may change at any time. We may accept Purchase Orders from institutions and organizations; please contact us with PO details before ordering. We reserve the right to refuse, cancel, or limit any order.

5. Shipping and live arrival

We guarantee that live organisms leave our facility healthy and alive. Because some species — particularly gelatinous organisms such as scyphozoans and ctenophores — are sensitive to transit, complications can occasionally occur. If organisms arrive dead, email us as soon as possible and we will send a one-time identical replacement at no additional charge; please attempt to maintain the animals for a few days first, as they may simply be lethargic. Cash refunds are not available for live organisms. We currently ship within the United States and Canada.

6. Permits and compliance

Whalore collects in accordance with applicable local and federal regulations. If your institution requires permits or documentation, let us know at the time of ordering.

7. Intellectual property

All content on this site — including text, images, logos, and graphics — is the property of Whalore Biosciences or its licensors and may not be copied, reproduced, or used without permission.

8. Disclaimers

The site and all materials are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that organisms will be suitable for any specific experiment or that the site will be error-free or uninterrupted.

9. Limitation of liability

To the fullest extent permitted by law, Whalore Biosciences will not be liable for any indirect, incidental, special, or consequential damages arising from the use of the site, the purchase or use of any organism or material, or the inability to use either. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles.

11. Changes to these terms

We may update these Terms from time to time. The current version will always be posted on this page, and changes apply to use of the site and orders placed after the date of the update.
